Jalandar, I firmly disagree. As the court said, "The heart of the argument on appeal concern[ed] whether the terms of the Artistic License are conditions of, or merely covenants to, the copyright license." By ruling "It is outside the scope of the Artistic License to modify and distribute the copyrighted materials without copyright notices and a tracking of modifications from the original computer files." the court made clear that open source licenses could be enforced as intended. They ruled that the motives of open source developers could not be discriminated against, stating "The choice to exact consideration in the form of compliance with the open source requirements of disclosure and explanation of changes, a dollar-denominated fee, is entitled to no less legal recognition. " Finally, they noted some of the benefits, including lower costs and faster debugging.
